Terms of Service

These Terms of Service (“Terms”) govern your access to and use of route1games.ca (the “Store”) and purchases made through the Store.

By accessing the Store, creating an account or placing an order, you agree to these Terms and the policies referenced in them, including our Refund Policy and Privacy Policy. If you do not agree, please do not use the Store.

The Store is operated by Blair Zwarich, a sole proprietor carrying on business as Route1Games (“Route1Games,” “we,” “us” or “our”).

These Terms apply to transactions completed through route1games.ca. Purchases made through eBay or another third-party marketplace are also subject to that marketplace’s applicable terms and policies.

You must have reached the age of majority in your province or territory of residence to place an order. If you have not reached the age of majority, you may use the Store only with the involvement and authorization of a parent or legal guardian.

By placing an order, you represent that the information you provide is accurate and that you are authorized to use the selected payment method.

Route1Games sells collectible trading cards and may offer raw cards, graded cards, sealed products and related collectibles.

We make reasonable efforts to describe products accurately and provide clear photographs and condition information. However, card-condition assessment involves a degree of judgment. Minor differences in opinion concerning a condition category do not necessarily mean that an item was misrepresented.

Unless a listing clearly states that its photographs are representative of multiple equivalent copies, photographs of a single card form part of the product description and show the actual item being offered.

For listings with multiple copies in the same stated condition, representative photographs may be used where clearly disclosed. The card received will be the same card, set, card number, variation and stated condition shown in the listing, but minor differences may exist between individual copies.

Raw-card condition does not guarantee that a card will receive any particular grade from PSA or another grading company. Grading-company standards, decisions and population reports are outside our control.

Please review the complete product description, stated condition and available photographs before purchasing.

All prices on the Store are expressed in Canadian dollars unless otherwise stated.

Applicable shipping charges and taxes, if any, will be disclosed during checkout before the order is submitted.

Collectible-card prices may change based on availability, condition and market activity. We may change prices at any time before an order is placed. A later increase or decrease in market value does not entitle either party to adjust or cancel a completed sale except as provided by our Refund Policy or applicable law.

Inventory is limited and may be offered through more than one sales channel. Although inventory is synchronized, an item may occasionally become unavailable before the Store is updated.

We reserve the right to correct pricing, inventory or descriptive errors before shipment. If an affected order cannot be fulfilled as presented, we will contact you and provide the option of accepting an appropriate correction or receiving a full refund.

We may establish reasonable quantity limits or refuse orders that appear fraudulent, abusive or intended for unauthorized resale.

Submitting an order constitutes an offer to purchase the selected products under these Terms.

An automated order-confirmation message acknowledges that we received your order but does not necessarily confirm final acceptance. An order is accepted when we begin fulfillment or issue a shipment confirmation.

Payment is processed through third-party payment providers. By submitting an order, you authorize the total charge disclosed at checkout, including product prices, shipping charges and applicable taxes.

We may cancel or decline an order for a lawful reason, including:

• Inventory unavailability
• An obvious pricing or listing error
• Suspected fraud or unauthorized payment
• An incorrect or undeliverable shipping address
• Violation of these Terms
• A technical or inventory-synchronization error

If we cancel an order after payment has been processed, the affected amount will be refunded to the original payment method.

Website orders are currently shipped to eligible Canadian addresses. International customers may be served through our third-party marketplace listings where available.

Available shipping methods, charges and estimated delivery times are displayed during checkout. Delivery dates are estimates unless expressly identified as guaranteed.

Orders may be delivered through Chit Chats, Canada Post or another shipping provider. Carrier delays caused by weather, service interruptions, remote-location access, customs, labour disruptions or other circumstances outside our reasonable control may affect delivery times.

Customers are responsible for providing a complete and accurate delivery address. If an order is returned because an incorrect or incomplete address was provided, additional shipping charges may apply before it is sent again. Original shipping charges may not be refundable in these circumstances.

Some lower-cost shipping options may not include tracking or a delivery scan. By selecting an untracked service, you acknowledge that shipment progress and delivery cannot be independently monitored. This does not limit any rights available under applicable law.

If an order appears delayed, lost or damaged, please contact [email protected] so we can review the shipment and available carrier remedies.

Please inspect your order promptly after delivery.

If an item arrives damaged, incorrect or materially different from its description, contact us in accordance with our Refund Policy and retain the item, packaging and shipping materials while the matter is reviewed.

Where tracking shows that an order was delivered but it cannot be located, customers should first check with household members, neighbours, building management and the delivering carrier. We will provide reasonable assistance with available carrier inquiries, but each case will be assessed based on its circumstances and applicable law.

Returns, refunds, damaged-item claims and exchanges are governed by our Refund Policy, which forms part of these Terms.

Nothing in these Terms or our Refund Policy limits any mandatory rights or remedies available under applicable consumer-protection law.

Information submitted through our “Sell Your Collection” page or by email is used to evaluate a potential purchase by Route1Games.

By submitting a collection, you represent that:

• You own the submitted items or have authority to sell them
• The information and photographs provided are accurate to the best of your knowledge
• The items are not stolen, counterfeit or subject to another person’s ownership claim
• You will disclose known alterations, damage or authenticity concerns

Any preliminary estimate or offer may be revised or withdrawn after physical inspection, condition verification, inventory verification or identification of missing, altered or counterfeit items.

A submission, estimate or discussion does not create an obligation for Route1Games to purchase a collection or for the seller to accept an offer. A transaction is only completed when final terms are agreed upon and the items and payment are exchanged.

Collection estimates are purchase offers and are not professional appraisals, insurance valuations or guarantees of retail market value.

If customer accounts are available, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

Notify us promptly if you suspect unauthorized access. We may suspend or disable an account where reasonably necessary to protect the customer, the Store or other users.

You may not use the Store:

• For an unlawful, fraudulent or abusive purpose
• To interfere with the Store’s security, availability or operation
• To attempt unauthorized access to accounts, systems or data
• To introduce malicious code or automated attacks
• To scrape, reproduce or systematically extract Store content without permission
• To submit false payment, identity, address or collection information
• To violate another person’s intellectual-property, privacy or legal rights

We may restrict access to the Store where we reasonably believe these Terms have been violated.

Route1Games owns or is authorized to use the Store’s original branding, logo, written content, layout and other original materials. These materials may not be reproduced, distributed or commercially used without permission.

Pokémon names, characters, card artwork, set names, grading-company names and other third-party trademarks and intellectual property belong to their respective owners.

Route1Games is an independent reseller and is not affiliated with, sponsored by or endorsed by The Pokémon Company, Nintendo, Creatures Inc., Game Freak or any grading company unless expressly stated.

Our collection, use, disclosure and protection of personal information are described in our Privacy Policy, which forms part of these Terms.

The Store may rely on or link to third-party services, including payment processors, delivery providers and marketplace platforms.

Those services may be governed by separate terms and privacy policies. We are not responsible for independent third-party websites or services except to the extent required by applicable law.

Collectible-card prices can rise or fall and past market prices do not guarantee future value.

Product descriptions, market information and collection estimates provided by Route1Games are not financial, investment, tax, grading or professional appraisal advice. Customers are responsible for making their own purchasing and collecting decisions.

We make reasonable efforts to keep the Store accurate, available and secure, but we do not guarantee that it will always operate without interruptions, delays or technical errors.

Products remain subject to their descriptions, our Refund Policy and applicable consumer-protection law. Nothing in these Terms excludes warranties, conditions, liabilities or remedies that cannot legally be excluded.

To the fullest extent permitted by law, Route1Games will not be liable for indirect, incidental, special or consequential losses arising from use of the Store or a transaction.

Where a limitation is legally permitted, Route1Games’ aggregate liability arising from a particular order will not exceed the amount paid for that order.

These limitations do not apply to fraud, wilful misconduct, gross negligence or any liability that cannot be excluded or limited by law.

These Terms and transactions through the Store are governed by the laws of Ontario and the applicable federal laws of Canada.

Any dispute will be submitted to a court of competent jurisdiction in Ontario, subject to any mandatory rights a consumer may have under the laws of their province or territory.

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

We may update these Terms to reflect changes to the Store, our practices or applicable law. The updated version will be posted with a revised “Last updated” date.

Changes will apply prospectively and will not alter the terms governing an order that was already accepted unless required by law or agreed upon by the customer.
